What is the 5-Year ILR Route?
The 5-year route to Indefinite Leave to Remain remains fully in force. The Government's “earned settlement” consultation — which proposes a longer standard qualifying period for future applicants — closed in February 2026, but no changes to the Immigration Rules have been made and no start date has been confirmed. Is the 5-year ILR route being scrapped for a 10-year “earned settlement” rule? ⌃

Not as things stand on 3 July 2026. The earned-settlement proposals are still only proposals — the consultation has closed, but no Immigration Rules have changed and no implementation date has been announced. The 5-year ILR route remains available. As reforms are expected later in 2026, applying at the right time is more important than ever, and we can advise you on your options.

Who can apply via the 5-Year ILR Route? ⌃

Anyone who has held continuous lawful residence for 5 years on a qualifying route — including Spouse/Partner visa, Skilled Worker visa, Innovator Founder visa, and other PBS categories — and who meets the specific requirements of that route can apply.

How is this different from Long Residence? ⌃

The 5-Year ILR Route is tied to a specific visa category and its requirements (financial, English, sponsorship, etc.). Long Residence is a separate, 10-year route used where no other settlement route applies, based purely on continuous lawful residence.

How many days can I spend outside the UK? ⌃

You must not exceed 180 days outside the UK in any rolling 12-month period throughout your full 5-year qualifying period — not just in the final year.

Can I apply before my 5 years are fully complete? ⌃

Yes. You can submit your ILR application up to 28 days before you complete your qualifying period.

What happens if my circumstances change partway through? ⌃

If your sponsoring partner or employer changes, your qualifying period may reset. We strongly recommend getting advice before any major change in circumstances.

What documents will I need? ⌃

Typically: your passport(s), proof of continuous residence, a full record of UK absences, evidence meeting your specific route's requirements (financial/sponsorship), and your Life in the UK Test certificate.

What is the current ILR application fee? ⌃

The standard ILR fee is £3,226 per applicant, as of 8 April 2026. Faster Priority and Super Priority services are available on some routes for an additional fee.

5-Year ILR Route Eligibility Requirements

To successfully apply via the 5-Year ILR Route, you must satisfy six distinct categories of requirement — covering continuous residence, absence limits, your route-specific financial or sponsorship threshold, English and UK knowledge, the correct form and timing, and good character.

Continuous Residence

You must demonstrate an unbroken period of lawful residence on a qualifying route.

  • 5 Full Years: Continuous lawful leave on a qualifying route (Spouse, Skilled Worker, etc.).
  • Correct Start Date: The period runs from the date your first visa was granted.
  • No Overstays: You must not have overstayed during the qualifying period.

Absence Limits

Two separate absence rules apply; exceeding either can reset your qualifying period.

  • 180-Day Rolling Rule: No more than 180 days outside the UK in any 12-month period.
  • 540-Day Total Cap: Total absences must not exceed 540 days over the full 5 years.
  • Exceptional Circumstances: Discretion requires robust, independent evidence.

Financial & Sponsorship

You must continue to meet the specific threshold attached to your underlying visa category.

  • Spouse/Partner: Continued income at or above the required threshold (£29,000).
  • Skilled Worker: Salary at or above the relevant threshold or "going rate."
  • PBS Routes: Maintaining specific endorsement or investment criteria.

  • English Language: Evidence at CEFR B1 level (may increase to B2).
