Overview
What happens after a sponsor licence refusal?
A refusal means the Home Office isn’t satisfied that your business meets the eligibility and suitability rules for a sponsor licence, so you can’t sponsor workers. Your refusal letter gives the reasons. There’s no right of appeal, and the application fee isn’t refunded.
Part 1 of the Home Office sponsor guidance gives two ways forward. If a caseworker made a simple error, or didn’t consider evidence you sent, you can ask for an error correction within 14 calendar days. Otherwise you can apply again once the cooling-off period (usually 6 months) has ended. A decision you believe was unlawful can be challenged in court by judicial review, which needs a solicitor.

Ready to apply again? Six questions, one minute
Answer honestly. Nothing is saved or sent: this is a general guide, not advice on your case.
Has the cooling-off period in your refusal letter ended?Usually 6 months from the refusal. Some refusals have none; civil penalties can mean longer.
Do you know exactly why you were refused, reason by reason?Your refusal letter lists each reason.
Have you fixed every reason, with evidence to show it?For example your HR systems, missing documents or the role you want to sponsor.
Are your Authorising Officer and Level 1 User eligible for those roles?Your Authorising Officer must be a paid member of staff or an office holder. Your main Level 1 User must be an employee, director or partner, and a settled worker.
Are you free of unpaid civil penalties and unspent convictions for relevant offences? This covers your Key Personnel and others the guidance treats as ‘you’.
Can you send all your supporting documents within 5 working days of applying? They’re listed in Appendix A to the sponsor guidance.
Eligibility
Sponsor licence refusal: your options
Check your refusal letter for its date and its reasons. The deadlines below run from the decision, not from when you get advice.
Error correction request
- For a simple caseworker error, such as wrongly applying a cooling-off period
- Or where evidence you sent with your application wasn’t considered
- It isn’t a full reconsideration, and evidence that wasn’t available when you applied won’t be looked at
- If the error is accepted, you’re invited to apply again and the new fee is refunded. If not, the cooling-off period still runs from the original refusal
A refusal is reviewed only once this way. We tell you whether it may fit and refer the request to a solicitor or higher-level adviser.
The cooling-off period
- No cooling-off if you were refused only because a representative sent your application, or because you couldn’t send requested documents in time for reasons outside your control
- Where more than one period applies, the longest one counts
- An application made during the cooling-off period is refused automatically, even if the reasons no longer apply
- You can’t get a licence at all while a relevant civil penalty is unpaid
Your refusal letter should say which period applies. If it’s wrong, that’s the kind of caseworker error the 14-day route covers.
Applying again
- The reasons you were refused must no longer apply: the end of the cooling-off period doesn’t guarantee a grant
- You pay the full licence fee again, and a compliance officer may check your systems before a decision
- If you’re refused again, a further cooling-off period applies
- You must submit the application yourself: an adviser can help you prepare it but mustn’t send it for you
This is where we help: we review the refusal, work through the fixes with you and prepare the application for you to submit.
Judicial review
- A court challenge to whether the decision was lawful, not a re-run of your application
- The court’s permission is needed before a claim can go ahead
- The time limit can’t be extended by agreement with the Home Office
- Pre-action letters and the claim itself must be handled by a solicitor or higher-level adviser
We tell you early if judicial review may be worth exploring, and refer you straight away so the time limit isn’t missed.
What else a refusal affects
- You can’t assign certificates of sponsorship, so you can’t sponsor anyone until you hold a licence
- For 6 months, people named as your Key Personnel may find another organisation’s licence application is normally refused
- Withdrawing an application to avoid a likely refusal normally brings the same cooling-off period
- The licence fee isn’t refunded
Your Key Personnel and their history are checked on every application, so plan who you nominate next time.
Documents
Sponsor licence documents: the easy part
Most businesses can gather the documents. Refusals come from what your documents and answers show about your business, your people and the role.
What everyone needs
- Your refusal letter, and any error correction reply
- Documents showing your business is genuine and trading in the UK
- Details of your Authorising Officer, Key Contact and Level 1 User
- Your HR, right to work and record-keeping processes
- £Details of the roles you plan to sponsor
- Any registration or licence your sector needs to operate
Supporting documents must reach the Home Office within 5 working days of applying, with certified translations of anything not in English or Welsh.
Costs & timeline
Sponsor licence reapplication cost and processing time
Applying again costs the full licence fee: £1,682 for a medium or large sponsor, or £611 for a small sponsor or charity. Most decisions take under 8 weeks; the £750 priority service aims for 10 working days.

Refusal letter
Day 0Read the reasons and the cooling-off period, and note the date: deadlines run from the letter.
Error correction deadline
Within 14 calendar daysOnly for a simple caseworker error or evidence that wasn’t considered. The Home Office aims to reply within 28 working days.
Judicial review time limit
Promptly, within 3 monthsIf the decision may be unlawful, a solicitor must act quickly. We refer you straight away.
Fix and prepare
During the cooling-off periodPut right each reason for refusal and gather your evidence, so you’re ready when the period ends.
Apply again
Usually after 6 monthsNew online application and fee. Most decisions take under 8 weeks, and the Home Office may visit first.
Avoid a refusal
Common sponsor licence refusal reasons
Most refusals come down to the business’s systems, people or evidence. These are the issues we check first.
Missing or late documents
Missing mandatory documents make an application invalid, and not sending requested information by the deadline leads to refusal.
We check: every document against Appendix A before you apply.
Systems that can’t track workers
The Home Office must be satisfied you’d know when a sponsored worker doesn’t turn up for work or their permission is ending.
We check: your HR processes against your sponsor duties.
A role that doesn’t qualify
You must be able to offer, and genuinely intend to offer, work that meets the requirements of the route.
We check: the roles you plan to sponsor against the route rules.
Key Personnel problems
An ineligible Authorising Officer or Level 1 User, or an unspent conviction for a relevant offence, means automatic refusal.
We check: who you nominate, and their history.
Information that doesn’t add up
False statements, or not giving information you held when asked, normally lead to refusal. A knowingly false document always does.
We check: your answers are complete and consistent.
Applying too soon
An application made during your cooling-off period is refused automatically, and a new refusal starts a further one.
We check: your cooling-off date before you pay any fee.

FAQs
Sponsor licence refusal questions, answered
Can I appeal a sponsor licence refusal?
No. There’s no right of appeal against the refusal of a sponsor licence application. You can ask for an error correction within 14 calendar days if a caseworker made a simple error or didn’t consider evidence you sent, or apply again after the cooling-off period. If the decision was unlawful, a solicitor can consider judicial review.
What counts as a caseworker error?
The guidance gives examples such as wrongly applying a cooling-off period, or not considering a document you sent with your application. It isn’t a chance to argue the case again or add new evidence. If the error is accepted, you’re invited to make a new application and that fee is refunded.
How long is the cooling-off period?
Usually 6 months from the date of refusal. There’s none in a few cases, for example if you were refused only because a representative sent your application. Certain civil penalties bring longer periods, from 12 months up to 5 years after payment.
Can we apply again straight away if we fix the problem?
Not during the cooling-off period: an application made then is refused automatically, even if the reasons no longer apply. Use the time to fix each reason and prepare your evidence, so you can apply as soon as it ends.
Will the Home Office visit us when we reapply?
It may. A compliance officer can check that you have the systems and procedures to meet your sponsor duties, and visits can be announced or unannounced. If you’re not ready, you’ll be refused again and face a further cooling-off period.
Does a refusal affect our directors or managers?
It can. For 6 months after a refusal, someone named as Key Personnel on your application may find that another organisation’s licence application is normally refused because of it. Tell us who was named so we can check.
Can you submit the new application for us?
No. The Home Office requires you to make the application yourself; if a representative sends it, it’s refused and the fee isn’t refunded. We help you prepare the form and documents for you to submit.
How long does a new application take?
Most are decided in under 8 weeks, though a compliance visit can add time. The £750 priority service aims for a decision within 10 working days, but places are limited each day.
